A judge from the Judicial Power of the State of Mexico, Tlalnepantla District, imposed justified preventive prison this Tuesday, October 14th, on Paulo Alberto “N” and Gabriel Rafael “N” for their probable involvement in the disappearance of CCH Naucalpan student Kimberly Moya.

Legal Proceedings and Next Hearing

In a hearing for the formulation of charges following an arrest warrant, the judge decreed the judicial detention of the accused and authorized a 144-hour period to determine their legal situation. During the hearing, the respective defenses of the accused requested the duplication of the constitutional term, reserving the right to present evidence they deem pertinent.

However, upon analyzing the evidence provided by the Public Ministry agent, the judge determined that there exist “risks for the victim and for society, as well as possible acts of obstruction in the development of the investigation.”

For this reason, the precautionary measure of justified preventive prison was imposed on both individuals. The continuation of the hearing was scheduled for Thursday, October 16th, at 12:30 hours.

Case Details

According to an information card from the Judicial Power of the State of Mexico, on October 2nd, Kimberly Moya was walking down a street in the San Rafael Chamapa neighborhood, municipality of Naucalpan, when she was allegedly pursued and intercepted by Gabriel Rafael “N”, who put her into a vehicle driven by Paulo Alberto “N”. Once deprived of her liberty, both subjects allegedly fled the scene, preventing knowledge of the adolescent’s current location or condition. To date, the accused persons are innocent until proven otherwise.
